Updated 3rd October 20251. INTRODUCTION
1.1. These Terms and Conditions apply to all transactions between You ("Client", "You", "Your", "Player", "User") and Topdeck Ventures Limited ("Company", "Us", "Our", "We", "Operator", "Topdeck", "WinPawa"). Topdeck Ventures Limited is a private limited company incorporated in Zambia, company registration number 120251027305.
1.2. These Terms and Conditions, available on Topdeck’s Website and Mobile Application, together with all the other documents referred to in them including Topdeck’s Privacy Policy, Cookies Policy, Betting Rules, Games Rules and the terms applicable to promotions, all of which form an integral part of these Terms, which are binding on the Client, constitute a legal contract that applies to and governs the relationship between You and Topdeck, and is valid for all activity conducted with Topdeck. By using Our Services, regardless of the means of access, You will be deemed to have read, understood and accepted the terms and conditions. You agree to be bound by these Terms and Conditions contained herein and as may be amended by Topdeck from time to time. If You have any questions, contact Topdeck for clarification beforehand.
1.3. No failure on Topdeck’s part to exercise, and no delay by Topdeck in exercising, any right under and in terms of these Terms and Conditions will operate as a waiver of that right, nor will any single or partial exercise of any right under these Terms and Conditions preclude any further or other exercise of that right nor act to the exclusion of any other right.
1.4. Topdeck shall not be bound by any express or implied term, representation, warranty, promise or the like not recorded herein. It is Your responsibility to ensure that You are fully acquainted and familiar with them, as well as the relevant national legislation.
1.5. Should Topdeck fail or decline to enforce the whole or part of these Terms and Conditions or grant any indulgence to You, then that act or omission shall not be interpreted as a waiver of rights, nor shall it act as an estoppel against or otherwise prejudice Topdeck.
1.6. "Website" ("Site", "Platform", "Service") means the website: winpawa.com, winpawa.co.zm and its Mobile Applications. The Platform is offered by Topdeck, third-party games are offered under license in agreement with Topdeck’s respective providers.
1.7. By using the Platform, You acknowledge and accept that such use is entirely at Your discretion, risk, and choice. Additionally, You agree that access to and use of the Platform is solely for Your entertainment and non-commercial purposes. In doing so, You affirm that You are acting on Your behalf and further acknowledge that any activities that violate these Terms are strictly prohibited. The Player must be an individual natural person.
1.8. By registering for an Account, You agree that Topdeck may communicate with You electronically to deliver information regarding Your purchases or Your account. Topdeck may also provide notices to You by posting them on the Platform, or by sending them via SMS to Your phone number, email address or street address that You previously provided to Topdeck. Notices posted through the Platform, SMS and Email shall be considered received by You within 24 hours of the time posted or sent; notices by postal mail shall be considered received within five (5) business days of the time sent. As part of the account registration process, You shall be required to provide certain personal information and documentation to verify Your identity.
1.9. These Terms and Conditions shall be governed by the laws of Zambia, any legal proceedings will be heard in the Zambian courts. Topdeck’s games are subject to the provisions of the Regulator. The Regulator is the statutory authority of Betting Control and Licensing Board vested with the responsibility to regulate gaming and betting activities.
2. CHANGES TO THESE TERMS
2.1. The Terms can be changed at any time by Topdeck at its discretion, including to comply with applicable laws and regulations and/or to keep up to date with changes to the Platform, the Services We offer, and/or Our business practices. All changes will become effective upon their publication on the Website unless stated otherwise.
2.2. Topdeck will notify Clients of any major amendment through a notification on its Website. Topdeck may also from time to time make minor/non-material changes to the Terms. These minor changes will not necessarily be notified to You and so You should check the Terms regularly for any such changes. Clients are required to accept the modified Terms before continuing to use the Website. It is Your responsibility to ensure that You are acquainted and familiar with any such changes.
3. ELIGIBILITY
3.1. The Services are provided to persons aged 18 years and above; who are fully competent and have the mental capacity to enter a binding legal contract; who are citizens and residents of Zambia, present on the Zambian territory, and are non-residents and or non- citizens of any other country.
3.2. Topdeck’s directors, partners, employees, contractors, agents and their immediate families, partners or household members are not eligible to participate in games and promotions provided on the Platform.
3.3. Any person who has an account which has a status that prohibits them from a playing or receiving a prize or winnings (including without limitation a person whose account has been suspended or terminated) is not eligible to participate in Topdeck’s games and promotions.
3.4. By participating in Topdeck’s games, You confirm that You are eligible to do so and are eligible to claim any winnings or prize. Topdeck may require You to provide proof of eligibility to enter the game, of the bet and further details as Topdeck may deem relevant.
3.5. Topdeck does not accept bets that are completed by third-parties, submitted in bulk, or generated by a computer system. Topdeck reserves all rights to disqualify You if Your conduct is contrary to the intention of a game, if You are under-age or if participation violates the laws of Zambia and or these Terms & Conditions.
3.6. By accepting these Terms, You are fully aware that there is a risk of losing money when gambling and You are fully responsible for any such loss. Concerning Your losses, You shall have no claims against Topdeck or any of its partners, or respective directors, officers, or employees.
3.7. By registering an account and generally using the Services, You represent, warrant, and agree that You will comply with all laws, statutes, and regulations in relation to Your use of the Services. Topdeck shall not be held liable for any unauthorized or illegal use of Your account or Topdeck’s Services. By accepting these Terms, You agree to cooperate with Topdeck in ensuring compliance with all applicable laws and regulations.
3.8. It is Your sole and exclusive responsibility to ensure full compliance with all laws and regulations governing online activity and/or gambling in Your location. Topdeck shall not be held liable in any circumstances where Your use of the account or the Website violates any applicable laws.
3.9. You are expected to always abide by these Terms, and You accept that any breach could lead to consequences, including but not limited to account suspension and closure, cancellation of bets, and forfeiture of winnings.
3.10. You must ensure that:
- You have not been excluded or prohibited from gambling (whether online or in person) whether voluntarily or otherwise;
- You are the rightful owner of the money which You at any time deposit in Your account, and but without limitation, You are not depositing money originating from criminal and/or other illegal activities;
- You are not depositing money through a payment method, that is neither in Your name nor owned by You;
- You are not depositing money through any third-party payment method that is directly funded by a third-party payment method, or through a business account;
- You fully understand and accept these Terms.
- all the personal details and documents You have provided upon registration are correct;
4. USER ACCOUNTS
4.1. All payouts via bank transfers and mobile money wallet shall only be made to the same natural person who registered and owns the account on the Platform and who has requested the payout. The personal details associated with the account must match the details of the bank account or mobile money wallet holder to which the payout is being requested.
4.2. Clients are strictly prohibited from selling, transferring, assigning, or otherwise allowing third parties or other Clients to use their accounts. If Topdeck becomes aware of or is notified of any such activity, the relevant account may be permanently closed, bets may be voided, and all winnings may be forfeited. Additionally, Topdeck reserves the right to seek further damages as appropriate.
4.3. Upon registering an account, You are responsible for ensuring the accuracy and completeness of all information and documents provided. Topdeck reserves the right to permanently close any account if the information or documents provided are found to be false, incomplete, or inaccurate.
4.4. Each account is uniquely associated with a specific phone number, and all transactions related to the account are linked to that phone number. Funds may not be transferred between accounts or from one phone number to another.
4.5. You may only register one account. Topdeck retains the right to close any or all accounts of any Client who has registered multiple accounts under their name, or under different names, if Topdeck has reasonable grounds to believe that those multiple accounts (even if under different names) have been registered with the intention of deceiving or misleading Topdeck by masking the totality of the activity of any individual or syndicate or to defeat Platform limits. Topdeck also reserves the right to cancel any transactions related to such accounts.
4.6. Upon registering an account, You are responsible for maintaining the confidentiality of Your account access details. Any transactions conducted where the login details have been correctly entered will be considered as actions taken by the Client. Topdeck shall not be liable for any claims arising from the Client's failure to protect or safeguard their account access details, including any unauthorized sharing or disclosure of such information to another under any circumstances.
4.7. It is Your responsibility to advise Topdeck of any changes of address or contact details through Customer Support. The Client has the right to request the permanent closure or temporary suspension of their account at any time by submitting a request to Customer Support.
4.8. Topdeck reserves the right to verify Your registration details, such as name, address, age, and payment methods used, at any time, by requesting certain documents. In the event the requests for documents are not completed by the Player, Topdeck may at its sole discretion, terminate the account, and withhold any funds that are present therein. Should the documents fail Topdeck’s internal security checks - e.g. if We suspect the details are misleading, tampered with or misrepresent the Player - Topdeck shall be under no obligation to accept such documents as valid, and We are under no obligation to provide feedback on the exact nature of findings with regards to these documents.
4.9. Topdeck reserves the right to perform background checks and to request any relevant documentation, for any reason, including (but not limited to) any investigation into the identity, credit checks performed, or any enquiries into the Player's personal history. The basis for such investigations will be dependent on the specific case, but could include (but is not limited to) verification of the Player's registration details, verification of the Player's financial transactions or standing, and or gaming activity. Topdeck is under no obligation to advise the Player of such an investigation taking place. Such activities may include the use of specific third-party companies, which perform the investigations as required. Topdeck may decide at its sole discretion to terminate a Player's account, and withhold funds should such an investigation provide a negative or uncertain conclusion.
5. DEPOSITS AND WITHDRAWALS
5.1. Clients may deposit or withdraw funds from their account using any of the payment methods currently available on the Platform. Topdeck reserves the right to verify the Client’s identity upon receipt of any deposit or withdrawal request.
5.2. Topdeck may utilize Payment Service Providers (PSPs) to process deposits and withdrawals from Your account. You hereby authorize Topdeck to engage PSPs, as necessary, to facilitate and process such transactions.
5.3. Deposits and withdrawals may be subject to charges or taxes imposed by the Client’s PSPs. Topdeck shall not be held liable for any such fees or charges. It is the Client’s responsibility to familiarize themselves with these charges before making any deposits or withdrawals from or to their account.
5.4. Topdeck may require You to make or maintain a minimum deposit in Your account to access and utilize the Platform and any of the Services offered. Placing bets on credit is strictly prohibited; specifically, the account balance may not be allowed to go into overdraft. Topdeck is not a bank nor a financial institution, and the balance held in Your account will not accrue interest. Topdeck does not offer any credit facilities.
5.5. You may withdraw Your real money deposits, and any winnings held in Your account, subject to the following conditions: all payments made into Your account must be confirmed as cleared and must not have been chargebacks, reversals, or any other cancellations; any identity or anti-money laundering checks required by Topdeck have been completed to Our reasonable satisfaction. If Topdeck has requested information from You to complete these checks, any delay in providing such information may result in additional delay when processing withdrawals; there is no ongoing investigation regarding Your account or any bet You have placed;
5.6. Topdeck does not accept deposits or facilitate withdrawals by cheque or cash. All deposits and withdrawals must only use the payment methods provided and approved by Topdeck.
5.7. Winnings may not be transferred, substituted, exchanged, or redeemed for any other price.
5.8. In order to prevent financial loss to You or to Topdeck, such as if We suspect a data breach or that an unauthorized person may have accessed Your Account, Topdeck may place a delay on a payment for a period of time, or limit payment methods for a transaction, or limit Your ability to make a purchase, or deactivate Your account. Topdeck reserves the right to scrutinize and verify all winnings and withdrawals before payment.
5.9. Each user of the Service is fully responsible for paying all monies owed to Topdeck. You agree that You will not make or attempt to make any charge-backs, and or deny or reverse any payment that You have made and You hereby agree to reimburse Topdeck for any charge-backs, denial or reversal of payments You make and any loss suffered by Topdeck as a consequence thereof. Topdeck may, at its sole discretion, cease to provide the Services or withhold payment to certain users or to users paying with certain payment methods.
5.10. You are solely responsible for any taxes applicable on any prizes and/or winnings You receive from Your use of the Website and Services, in addition to any taxes that, under applicable law, must be withheld and remitted by Topdeck on Your behalf.
5.11. All required information must be entered truthfully during registration; Entering an invalid phone number or email address might make it impossible to reset Your password or withdraw any funds. It is Your responsibility to keep Your login details secret.
5.12. If Topdeck has reasonable suspicion that You may be engaging in or have engaged in fraudulent, unlawful or improper activity, including, without limitation, money laundering activities, or conduct otherwise in violation of these Terms and Conditions, Your access to the Services may be terminated immediately and or Your account blocked, Topdeck is under no obligation to refund to You any funds that may be in Your account. Topdeck shall be entitled to inform relevant authorities, other online service providers and banks, credit card companies, electronic payment providers or other financial institutions of Your identity and of any suspected unlawful, fraudulent or improper activity and You will cooperate fully to investigate any such activity.
5.13. Topdeck prohibits utilization of any techniques to circumvent the standard house edge in its games. If Your account indicates that You are using such techniques, Topdeck shall immediately block Your account and retain any funds in said account.
6. BETTING
6.1. Each Client is responsible for verifying that the bet details and the amount staked are accurate before submitting a bet. Once submitted, a bet cannot be modified or cancelled by the Client.
6.2. A valid bet must meet these conditions:
- Is not fraudulent;
- The bet has been offered by Topdeck;
- Is not a credit bet;
- must be placed with Topdeck using any of the prescribed methods used by Topdeck from time to time to offer bets to punters;
- was submitted by a person of 18 years or older;
- is not a void bet as may be determined elsewhere in the Terms and Conditions
6.3. A bet submitted to Topdeck does not become valid until funds have been deducted from Your account and a transaction code or ticket has been issued by Topdeck.
6.4. Topdeck shall not be obliged to accept a bet or pay out monies in respect of a bet that is not a valid bet. If You have any doubts as to whether a bet has been accepted and is accordingly valid You should check with the Customer Support.
6.5. Topdeck reserves the right to refuse, accept, or partially accept any bet submitted without offering any explanation. Where Topdeck wholly or partially refuses a bet, the amount deducted shall be refunded to the Client’s account.
6.6. Topdeck reserves the right to modify the maximum and minimum stake amounts, as well as maximum winnings applicable to specific Services. These changes will be reflected in the relevant sections of the Platform. It is Your responsibility to review these terms each time You log in.
6.7. The amount of bets per day You are permitted to purchase is subject to limitations established by Topdeck. At any time, You may maintain only one account.
6.8. It is Your responsibility to ensure that the details of all bets are correct. If You dispute the details of any bet, Topdeck’s transaction log database will be final and binding in determining the outcome of that dispute. If You dispute the time at which a bet was placed, the time recorded in Topdeck’s transaction log in respect of that bet will be binding and Topdeck’s determination thereof will be final and binding on You.
6.9. All bets on contingencies which have already arisen, or where You could have an indication of the outcome at the time of placing the bet, or where Topdeck has continued to accept bets on an event which should have been suspended for any reason, shall be void. Any bet placed after the start of an event shall also be void.
6.10. Settlement or payments in respect of Betting Account will be made to the account holder only and not to any third party in any circumstance. The customer’s right to settlement or payment is not transferable or negotiable. Winnings must be collected within 60 days of conclusion of the winning bet. For guidance on betting rules, including event cancellations, please refer to the rules listed on the Platform and on the specific game or event.
6.11. Should funds be credited to Your account in error, it is Your responsibility to immediately notify Topdeck of the deposit. Any winnings paid to You as a result of the error, whether linked to the error or not, shall be deemed to be invalid and will be repayable by You to Topdeck and You are deemed to agree and accordingly hereby authorize Topdeck to deduct from Your account the sum of the winnings incorrectly paid into Your account.
6.12. Topdeck reserves the right to verify the identity of all account holders at any time and particularly on withdrawal of funds. Topdeck, in its sole discretion, may require a client withdrawing funds to affirm, by way of signed and notarized affidavit, that the bets recorded as taken on their name are in fact, their bets and not bets for any third party.
6.13. Topdeck reserves the right in its sole discretion to deem any bet that does not comply with these terms and conditions as void. In the event of a void bet, the bet will be declared void ab initio and: all winnings paid under a void bet will be forfeited and refundable to Topdeck on demand.
6.14. Your activity on the Website and use of the Services are reviewed by Topdeck for any irregular activity, at its sole discretion. If it is determined that You have engaged in irregular activity, Topdeck reserves the right to withhold and or confiscate any withdrawals and/or winnings or bonuses. Topdeck may also withhold any bonus, winnings or promotion balance as a fee.
6.15. In instances where there is evidence of a series of bets, each containing the same or very similar selections, having been placed by or on behalf of the same individual, syndicate, or group of individuals, Topdeck reserves the right to void such bets.
6.16. If You have participated in betting activities in a professional capacity, or in conjunction with other Client(s) as part of a club, group, or similar organization, or have placed bets in a coordinated manner with other Client(s) involving the same or substantially similar selections, Topdeck reserves the right, at its sole discretion, to limit the total maximum payout for the combined value of such bets to the equivalent of the maximum payout limits applicable to a single Client. The Website and account are intended solely for individual use and personal entertainment only, Topdeck reserves the right to withhold and or confiscate any withdrawals and/or winnings or bonuses related to such activity.
6.17. It is strictly prohibited for Clients to engage in any activities that violate applicable laws regarding gambling, including but not limited to collusion, fraud, and the use of unauthorized payment methods.
6.18. It is an offence for a Player to cheat in a game as per the Regulator. Topdeck may choose to seek compensation from You if You notice and fail to report a loophole, error or system malfunction.
7. BONUSES, PROMOTIONS AND PUBLICITY
7.1. From time to time, Topdeck may offer bonuses or promotions, which will be governed by these Terms and the specific terms applicable to each promotion. Promotions are offered at Topdeck’s discretion and may be restricted on an individual account basis at any time.
7.2. Topdeck reserves the right, without the obligation to provide reasons, to exclude You from receiving selected bonuses, promotions, or any other offers introduced from time to time. Topdeck may also prevent You from taking part in or completing, any bonuses or promotions, including those You are currently engaged in.
7.3. Topdeck reserves the right to remove any promotion from the Website at any time, without prior notice or the need to provide a reason.
7.4. By using the Website and accepting any prize and/or winnings, You consent to be contacted by Topdeck and to advertise and promote the winning event, without additional compensation, except where prohibited by law.
7.5. Topdeck reserves the right to advertise all winnings through all types of media broadcasting, including the internet, regardless of the amount, and to use such winnings in its marketing campaigns, the details may include Your name and or nickname, hometown, photograph, video materials and any additional information. In this regard, Clients may be asked to provide photographs and/or participate in photographs and videos, which may be used by Topdeck for future marketing and public relations purposes, without any time or geographical limitations. You have the right to refuse to provide such photographs or participate in such photographs and videos. If necessary or specifically requested, Topdeck will make reasonable efforts to disguise the Client's identity for marketing and public relations purposes. You shall have no claim against Topdeck for invasion of privacy or any other ground(s) by reason of the publication or broadcast.
8. PROHIBITED ACTIVITIES
8.1. Topdeck strives to ensure that the use of its Services provides a safe and enjoyable experience for the Clients. Accordingly, Topdeck reserves the right to take any necessary actions in the event of suspected prohibited activity, including blocking accounts, freezing funds, and initiating legal proceedings. Any criminal or suspicious activities may be reported to the relevant authorities.
8.2. Topdeck reserves the right to monitor activity on the Platform and the use of its Services for any inappropriate language or behavior, illegal conduct, criminal activity, dishonesty, cheating, irregular play, bad faith, fraudulent activity and problem gambling. All such activities and conduct are expressly prohibited and may result in corrective action, including but not limited to immediate permanent suspension of the offending account.
8.3. If You suspect that an individual is engaging in any prohibited activity, You agree to promptly report the matter to Topdeck by contacting the Customer Support team. The following, without limitation, are expressly prohibited activities concerning the use of Topdeck’s Website and Services:
- exploitation or misuse of bugs, glitches, disconnections, or other similar errors or malfunctions of the Website;
- the use of any form of artificial intelligence, automated scripts, or bots;
- hacking, reverse-engineering, attempting to compromise, or otherwise abusing the Website, including any servers, software, or other components associated with the Website or Services;
- use of software or tools to bypass any geographic restrictions applied to the Website or to conceal Your actual location, including but not limited to the use of VPN service;
- engaging in match-fixing, cheating, or collusion;
- participating in, assisting, or facilitating any form of criminal, fraudulent or illegal activity;
- engaging in abusive chargeback practices;
- attempting to disrupt the Website and any of Topdeck’s Services or circumventing the technical measures implemented to maintain the security and integrity of the Website and Services;
- using a credit card or any other credit-based payment method as a source of funds in Your account;
- using any payment method whether directly, via a digital wallet, or through a mobile money wallet that is not registered in Your name to deposit into Your account, regardless of whether You have obtained authorization from the owner of the payment method;
- utilizing a stolen, cloned, or otherwise unauthorized payment method as a source of funds for Your account, or depositing money into Your account derived from illicit, criminal, or otherwise illegal activities;
- engaging in the manipulation of any feature including but not limited to promotional or bonus features;
- utilizing Topdeck’s Services for purposes other than for Your personal use;
- allowing or permitting whether intentionally or unintentionally, another party to use Your account;
- using a payment method for deposits or withdrawals which is registered under a name that is different from the name You used to register Your account;
- using a payment method associated with or belonging to a third-party, corporate or business account to perform deposits or withdrawals, including businesses where You may be a shareholder or director;
- using Topdeck’s Services while in the process of becoming or being declared bankrupt;
- engaging in any aggressive, obscene, or otherwise offensive behavior towards Topdeck’s clients, directors, officers, staff, or employees, including within the chat functionality on the Platform;
- providing false, incorrect, incomplete, or misleading personal details to register Your account, or making any subsequent changes to such information that are false, incorrect, incomplete, or misleading;
- Providing false, incorrect, incomplete, or misleading documentation, including to complete Topdeck’s Verification of Identity (KYC) or Anti-money Laundering (AML) checks;
- Conduct that violates any law, regulation, or court order;
- Using the Platform to access, collect or store personal information about others;
- Conduct that violates or infringes upon the rights of anyone else, including, for example, another person’s right to privacy;
- Impersonating any person, business, entity, or IP address (e.g. IP spoofing);
- Uploading, posting, emailing, transmitting or otherwise making available any materials that You do not have a right to make available under any law;
- Activity that is commercial in nature, including, for example, advertising, promotional or marketing materials, or spam, phishing or other unsolicited messages;
- Altering, damaging, or deleting any content posted on Topdeck’s Platforms;
- Conduct that otherwise violates these General Terms and Conditions or any other guidelines or policies posted on Topdeck’s Platforms.
9. DISPUTES, COMPLAINTS AND ENQUIRIES
9.1. All disputes, complaints and enquiries should be made by contacting Topdeck’s via its Customer Support email address. You hereby undertake to raise these disputes, complaints and enquiries with Customer Support and to provide all the relevant information or evidence which Topdeck reasonably requires to review Your matter.
9.2. If the outcome of a bet is disputed, You agree that Topdeck’s server logs and records are the final authority when determining the validity of any claim.
9.3. If there's a disagreement between the result displayed to You and Topdeck’s server, results on the server will prevail.
9.4. When Topdeck intends to reach You, We will use the phone or email address You provided to during registration or the phone, email address, postal address or street address from Your transactions or payment methods.
9.5. No claims or disputes will be considered more than 90 days after the date of the original transaction.
9.6. If You do not agree with Topdeck’s decision, You should contact Topdeck’s Customer Support Manager to appeal the decision and provide Topdeck with all the relevant evidence in relation to Your appeal promptly.
9.7. Topdeck’s decision about whether or not a bet is a winning bet, or in relation to any other matter or dispute arising from the payment or non-payment of Prizes and Winnings, will be final and binding provided; without limiting the effect of the previous sentence, following any such decision made by Topdeck, We may at Our discretion, reimburse the cost of the bet or replace the disputed bet with a new bet of the same price; this remedy will be the Player's sole and exclusive remedy, and any reimbursement or replacement will fully discharge Topdeck from any liability in respect of such a dispute; Topdeck will not be liable to pay any interest in respect of any reimbursement; Topdeck may withhold payment of a Prize or Winning and or make an equivalent payment into court until any dispute has been resolved.
9.8. In the event of suspected fraudulent activity, including but not limited to the use of stolen payment methods or any other prohibited activities, Topdeck reserves the right to suspend or block any account, reverse any payouts, and recover any funds or winnings associated with such activity. Furthermore, Topdeck is entitled to notify the relevant authorities or regulatory bodies regarding any suspected payment fraud or other unlawful conduct. Topdeck may also engage third-party collection agencies to recover any outstanding payments arising from fraudulent actions.
9.9. Notwithstanding the above, Topdeck shall not be held liable for any unauthorized use of mobile money wallets, credit cards, or debit cards, regardless of whether such cards or wallets were reported as stolen.
9.10. Any complaint must be promptly reported to Customer Support. Topdeck will make reasonable effort to resolve and settle amicably any complaint arising out of or in connection with these Terms. You agree that when You contact Topdeck, You will supply any related information required.
9.11. In the event of any dispute, the Client and Topdeck both agree that the records maintained in the Company’s server logs shall be considered the definitive source of information in determining the outcome of any complaint or claim.
9.12. In the event of a dispute between the Client and Topdeck, both parties agree to first attempt to resolve the issue through internal discussions. The Client should submit a formal complaint in writing to the Company’s Customer Support team, who will acknowledge receipt of the complaint within three business days. Topdeck will then review the complaint and provide a resolution or response within five business days from the date of acknowledgment. If the dispute is not resolved to the satisfaction of the Client within five business days, the Client may escalate the matter as per the procedure outlined in the Complaints Resolution Process, which is available on demand from the Customer Support agent assigned to the Client’s complaint.
9.13. In the event that a dispute remains unresolved following the Complaints Resolution Process, the dispute may be referred by the Client for arbitration within fourteen days.
10. PLATFORM RIGHTS
10.1. Topdeck reserves the right to refuse Your registration as a client and We may, at Our sole discretion, elect to deregister, suspend, or exclude You temporarily from the Platform, or permanently close Your account, at any time, for any reason, or without providing any reason.
10.2. You acknowledge that Topdeck has no obligation to provide prior notice of any decision to refuse, deregister, exclude, or suspend You as a Client. Furthermore, Topdeck is not required to provide any reasons for such decisions.
10.3. If Topdeck deregisters, excludes, or suspends You, We shall have the unlimited right to:
- withhold payment to You of any contested funds, including but not limited to deposits, refunds, bonuses, free monies, credits, payouts, or any other similar amounts, to the extent permitted by law;
- establish specific criteria with which You must comply to gain or maintain access to Your account and, if applicable, the Platform in general;
- provide relevant information about You to law enforcement agencies if Your deregistration, exclusion, or suspension is due to fraud or any other form of illegal misconduct. By agreeing to these terms, You irrevocably authorize Topdeck to take such actions;
10.4. If You wish to voluntarily suspend Your account temporarily, You may contact Topdeck’s Customer Support. During the suspension period, Your funds will be inaccessible and cannot be withdrawn unless Topdeck at its sole discretion decides otherwise; however, any remaining balance will stay in Your account.
10.5. Topdeck reserves the right to temporarily suspend Your account if We have reason to believe You have engaged in any prohibited activity. During this suspension, Your account will remain inaccessible while the matter is investigated, and Topdeck may contact You to request further additional information or documentation. If, following Our investigation, Topdeck determines (acting reasonably) that the issue has been resolved to its satisfaction, the suspension will be lifted. However, if Topdeck reasonably concludes that You have engaged in prohibited activity, We will permanently close Your account with immediate effect. In such cases, Your details may be provided to the relevant regulatory authority or other appropriate external third parties. Be advised that during the suspension, You will not be able to access or withdraw any funds from Your account. Any balance will remain on hold pending the completion of the investigation.
10.6. Topdeck reserves the right to restrict access to, temporarily suspend, or permanently close Your account as necessary to comply with regulatory or legal requirements and/or to adhere to the terms of Our license.
10.7. Topdeck reserves the right to withhold payment and to declare bets on an event void if there is evidence suggesting that the integrity of the event has been compromised, manipulated, or match-fixing or rigging has occurred. Such evidence may include but is not limited to, the size, volume, or pattern of bets placed with Topdeck across any or all of Our betting channels.
10.8. Topdeck reserves the right to permanently close Your account if We determine that You have breached any of these Terms or any other applicable rules or if Your actions are deemed to be inconsistent with the intent of these Terms. You acknowledge and agree that Topdeck is not required to provide prior notice of any such termination of Your account.
10.9. Topdeck reserves the right to exclude Clients from access to the Website. In such cases, Topdeck may decline deposits into or withdrawals from Your account. A refund of any residual credit balance in the account will be permitted unless a breach of these Terms has occurred. If the account has been terminated due to a violation of these Terms or involvement in prohibited activities, the residual credit balance may be forfeited. Bets will not be carried forward if the account is terminated.

Should Your account become dormant, defined as a period of ninety (90) consecutive days of inactivity (i.e. without any deposit, withdrawal, or bet placement) or as per the minimum period declared by the Regulator, Topdeck reserves the right to impose a monthly administration fee or to terminate the account. Topdeck reserves the right to make reasonable efforts to return any outstanding balance to Your nominated bank account or mobile money wallet, if feasible, once the account becomes dormant. The return payment will be made to the last registered mobile money wallet or bank account in Your name, as reflected in Your account details.
10.13. Where payment cannot be made to the last registered mobile money wallet, the remaining balance shall be handled following any lawful direction issued by the Regulator.
10.14. You can close Your Account by contacting Topdeck’s Customer Support. Topdeck will return any unused account balance less the withdrawal fees, using a method of its choosing. Topdeck may terminate Your account and refund the account balance less the withdrawal fees, at any time and without providing a reason.
11. MALFUNCTIONS, ERRORS AND INTERRUPTIONS
11.1. Under certain circumstances, a bet may be confirmed, or a payment may be processed in error. The following is a non-exhaustive list of such circumstances:
- A bet involving dependent events is inadvertently accepted due to a human or technical error;
- Prices (odds) offered by Topdeck are substantially different from those generally available in the market;
- An error occurs in the settlement process while calculating or crediting the amount of winnings to the Client’s account;
- A deposit or withdrawal is inaccurately recorded;
11.2. In such cases, Topdeck reserves the right to rectify all financial transactions, cancel any accepted bets associated with the error, or re-settle bets at the correct price, being the price that should have applied at the time the bet was placed.
11.3. Where an error, mistake, or system failure results in an incorrect price or line being applied to a bet, the bet or the affected portion of the bet, shall be deemed null and void.
11.4. In the event of a Platform or system malfunction, all bets shall be considered void. Topdeck reserves the right to void any winnings obtained because of hardware or software errors or malfunctions. Topdeck shall not be liable for any loss incurred by You because of such suspension or delay.
11.5. Should You have withdrawn any such winnings, You agree to return them to Topdeck. Failure to do so may result in temporary suspension or termination of Your account, and Topdeck reserves the right to seek further damages.

13.6. You agree that:

13.8. Topdeck reserves the right to suspend, withdraw, or restrict access to all or any part of the Website or Services (including, but not limited to, Customer Support) for business or operational reasons. Reasonable notice of any such suspension or withdrawal will be provided to the Client, where practicable;
13.9. A force majeure event shall include but is not limited to, accident, fire, war, civil unrest, pandemic, epidemic, quarantine, breakdowns of communication channels or facilities, explosion, earthquake, floods, storm, national or industrial strikes, uprisings, or any other similar events or circumstances beyond Topdeck’s control, which it could not reasonably have anticipated, avoided, or mitigated.

14. SEVERABILITY

16. TERMINATION
16.1. You may terminate the agreement to these Terms and Conditions and Your account at any time by sending an email to Customer Support, such termination will take effect upon Topdeck terminating Your account. You shall remain responsible for any activity on Your account between sending Topdeck an email and the actual termination of Your account.
16.2. On termination of the Terms and Conditions You shall: Discontinue the use of the Software and the Services; Pay all amounts due and owing to Topdeck; and remove and permanently delete the Software from Your computer equipment and destroy all related documentation in Your possession, custody, power or control. The right to terminate the Terms and Conditions given by this clause shall not prejudice any other right or remedy of either party in respect of the breach concerned (if any) or any other breach.
16.3. Upon the termination of the agreement to these Terms and Conditions for any reason, except as otherwise provided in the Terms and Conditions and subject to any rights or obligations which have accrued prior to termination, neither party shall have any further obligation to the other under these Terms and Conditions. In the event of Topdeck’s termination of these Terms and Conditions on account of Your breach of the Agreement, Topdeck will be under no obligation to refund to You any funds that may be in Your account and You shall have no claims against Topdeck in such regard.
17. GENERAL
17.1. You and Topdeck both agree that the sole and exclusive forum and remedy for resolution of a Claim be final and binding arbitration. You and Topdeck agree that the arbitration of any Claim shall proceed on an individual basis, and neither You nor Topdeck may bring a claim as a part of a class, group, collective, coordinated, consolidated or mass arbitration. A claim to resolve any Claim against Topdeck will be deemed a Collective Arbitration if (i) two or more similar claims for arbitration are filed concurrently by or on behalf of one or more claimants; and (ii) representation for the claimants are the same, share fees or coordinate across the arbitrations. "Concurrently" for purposes of this provision means that both arbitrations are pending (filed but not yet resolved) at the same time.
17.2. 17.3. By registering for Topdeck’s Services, You expressly consent to the collection, use and disclosure by of Your Personal Information by Topdeck, its employees, agents, partners and or service providers for the purposes of conducting and administering Services. You accept that Topdeck has the right to send You communication and promotional messages unless You explicitly opt out. Topdeck respects Your privacy and shall always make efforts to preserve Your information in strict confidence, however, Topdeck shall not be liable for any loss of data. 17.4.
